Understanding the Criminal Justice System in Texas

The criminal justice process in Texas begins with an arrest. After an arrest, the individual will be taken to a police station for booking and then transferred to a county jail. From there, the individual will havethe opportunity to post bail and be released, or remain in custody until their trial.

Once bail has been set, the individual will be given a court date for their arraignment. At the arraignment, the individual will be formally charged with a crime and have the opportunity to enter a plea of guilty or not guilty. If the individual pleads not guilty, the case will move on to the pre-trial phase.

During the pre-trial phase, the prosecution and defense will exchange evidence and witness information in preparation for trial. If a plea bargain is reached, the case can be settled without going to trial.

However, if a plea bargain is not reached, the case will proceed to trial.
