Best Thing To Do If You Are Arrested During A Protest

2020 has been an interesting year to say the least and we are now experiencing people being arrest for invoking their First Amendment right to free speech. If you or a loved one is planning to attend or participate in a protest, being prepared for an arrest is always a good idea.


Outside of having bail money ready and your attorney on speed dial, shutting up is the best thing you can do. As this is the best advice in most police interactions, this situation one is no different. There is no law that says you need to speak to the police outside of providing your name in certain situations –and contrary to popular belief, they are not permitted to ask you about your immigration status. There is a 100% chance that you will not say something to incriminate yourself if you say nothing at all.

While officers may not be able to arrest you for protesting, they can arrest you for protesting out of a designated, time, place, and manner. They can disguise the arrest as ensuring public safety if the way you are protesting violates a law, such as a curfew which would result in you potentially having to bond out and obtain counsel.
